By accessing or using MindSpeak AI's website, products, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.

2. Description of Services

MindSpeak AI provides personal AI companion products and services, including but not limited to: AI-powered memory and conversation agents, physical companion devices ("The Toy" and "The Tower"), and related software applications. Our Services are designed to learn from your personal data to create a personalized AI experience — your "Second Brain."

3. Account Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content

You retain ownership of all content you provide to our Services ("User Content"), including photos, journal entries, conversations, and other personal data. By submitting User Content, you grant MindSpeak AI a limited, non-exclusive license to process, store, and use your content solely to provide and improve the Services for you.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not violate any third-party rights
• Your User Content does not contain unlawful, harmful, or objectionable material

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable law or regulation
• Infringe on the intellectual property or privacy rights of others
• Transmit malicious software, spam, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts

6. Intellectual Property

The Services are protected by copyright, trademark, and other laws. Nothing in these Terms grants you a right to use the MindSpeak AI name, logos, or trademarks without our prior written consent.

7. Physical Products

For purchases of physical companion devices ("The Toy," "The Tower"), the following additional terms apply:

• Products are subject to availability and may have limited quantities
• Prices are subject to change without notice
• We reserve the right to refuse or cancel orders at our discretion
• Product warranties are provided separately with each device
• "The Toy" is intended for use by children under adult supervision

8. AI-Generated Content

Our Services use artificial intelligence to generate responses, insights, and content based on your interactions. AI-generated content is provided for informational and companionship purposes only. It should not be relied upon as professional advice (medical, legal, financial, or otherwise). MindSpeak AI does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MindSpeak AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services. Our total liability for any claims arising out of or related to these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. You may request a copy of your data before termination. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindSpeak AI is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration, except where prohibited by law.
